Legislation Could Lead to States’ Rights Showdown
The Afghanistan quagmire worsens day by day, the Federal government is facing the cold, hard facts of economic reality, and Obama's approval rating continues to sink. Looks like the people are starting to roll up their shirt sleeves so they can start fixing these messes themselves -- and the only way they can do it is to recall their delegated powers back from DC. Now Missouri's jumping in:
Missouri State Sen. Jane Cunningham (R-Chesterfield) drew much applause Saturday afternoon when she informed the crowd at the Million Med March about the Health Care Freedom Act she is going to introduce soon in the Missouri Senate.
The favorable response was due, in part, to the fact that the crowd of more than 300 included physicians, nurses, other health care professionals and “ordinary Joes” gathered in the St. Louis suburb of Clayton to protest the possibility of a government takeover of the nation’s health care system.
A Constitutional amendment, the act would protect Missourians from the un-Constitutional federal health care mandates and protect their rights to make their own medical and insurance choices, according to Senator Cunningham.
Best of all, she said, the Constitutional amendment will not require the signature of the governor if it gets through the House and the Senate.
“Instead,” Senator Cunningham said with a smile on her face, “it will go directly to a vote of the people.”
Similar efforts are being waged in at least 20 states, the senator added.
“If we get all of these through our legislatures,” she explained, “it will set up a showdown on states’ rights before the U.S. Supreme Court, and I say, ‘Bring it on!’”
Not that we can trust the Supreme Court, which is nothing but a branch of the District of Corruption, to objectively determine the Federal government's own powers -- but this is still a bold step in re-asserting States' Rights against an increasingly useless, out-of-control regime.

Should a showdown come in the US Supreme Court between the Feds and the States, the outcome probably would necessitate invoking the principle of nullification on the part of the latter. This would be mighty interesting.

Not only would it bring nullification, but it would also bring about witholding federal tax`payments to the state from the feds. This in turn would lead to the respective state keeping federal taxes collected to starve the federal leviathan.
After that an interesting donnybrook should ensue.

A nice step would be for our States to order their National Guard units home and to stop any State funding or support for the Guard if the Feds refused to allow them to come home. I for one would like to see SC simply abolish its National Guard since this is used as an auxillary force by the Feds in their various evil wars of aggression. We have a State Guard in SC and our State Guard could be reconstituted as the militia of the State with no Federal power over it.
Nullification: An idea whose time has come.

Even Yankees are beginning to understand: the South was right.
If the states and the people do not stand up to the Federal government NOW, its consolidation of power will only proceed apace. NOW is the time to kill Leviathan.
